Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Eternal Trading LLC, a California limited liability company ("Eternal Trading," "we," "us," or "our"). By creating an account, accessing the Service, starting a trial, purchasing a subscription, or otherwise using Eternal Trading, you agree to these Terms.

If you do not agree, do not create an account, start a trial, purchase a subscription, or use the Service.

You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. You are responsible for providing accurate account information, maintaining the confidentiality of your login credentials, and promptly notifying us if you believe your account has been compromised.

You may not share, sell, transfer, or provide unauthorized access to your account or subscriber-only content.

Eternal Trading is a subscription-based financial information and research platform focused on SPY options. Depending on your access level, the Service may include:

• SPY options entry, partial-exit, and final-exit alerts;
• in-app notifications and optional email delivery;
• current-position information and contract details;
• trade history and realized performance information;
• public and subscriber-only market or performance information; and
• account, notification, and subscription-management tools.

Features may change over time as the platform is updated. We may add, modify, suspend, or discontinue features when reasonably necessary for operations, security, compliance, maintenance, or product development.

Eternal Trading provides the same general market information and alert service to eligible subscribers. Alerts and platform content are not customized to your income, net worth, portfolio, objectives, experience, tax situation, risk tolerance, or other personal financial circumstances.

Eternal Trading does not place orders for you, access your brokerage account, hold or custody customer trading funds, or guarantee that any trade or strategy is appropriate for you. You are solely responsible for deciding whether to enter, hold, modify, or exit any position.

Nothing on the Service is individualized legal or tax advice. Consult appropriately qualified professionals when you need advice specific to your circumstances.

Trading securities and options involves substantial risk. Options can be highly volatile, may lose value rapidly, and may expire worthless. You can lose all of the premium paid for an option, and certain options strategies can expose a trader to losses greater than the initial investment.

Before trading, you should understand the product, your broker's requirements, liquidity, bid-ask spreads, expiration risk, volatility, assignment or exercise risk where applicable, and the amount you can afford to lose.

Eligible new subscribers may receive one 7-day free trial. A valid payment method is required to begin the trial. Trial eligibility is determined by Eternal Trading and may be limited to one trial per account or customer.

Unless you cancel before the 7-day trial ends, your subscription will automatically convert to a paid subscription at $30 per month. After the first paid charge, the subscription will automatically renew each month at $30 per month until canceled, plus any applicable taxes.

We may change subscription pricing in the future. Any price change will be communicated and implemented in accordance with applicable law before the changed amount is charged.

You may cancel your subscription at any time. The primary online cancellation method is available after login through Eternal Trading:

• open Settings;
• select Subscription;
• choose Manage Billing; and
• complete the cancellation through the secure Stripe customer portal.

If you cancel during an eligible free trial before the first paid charge, future paid renewal should be prevented. If you cancel after a paid subscription charge, cancellation generally stops future renewals and access may continue through the end of the then-current paid billing period.

Subscription fees are non-refundable once charged, and we do not provide prorated refunds or credits for partial billing periods, unused access, missed alerts, the absence of an alert during a particular period, or trading outcomes, except where required by applicable law or as otherwise stated in our Refund Policy.

Please review the Refund Policy before starting a paid subscription.

Subscription checkout and billing management are processed by Stripe. Eternal Trading does not directly collect or store your full payment-card number. Your use of Stripe's payment services may also be subject to Stripe's terms and privacy practices.

You authorize the applicable payment processor to charge the payment method you provide for subscription fees, taxes, and other amounts you validly authorize under these Terms.

Alerts may be delivered through in-app notifications and, when enabled, email. Delivery can be affected by internet connectivity, browser behavior, email-provider filtering, service-provider outages, maintenance, device settings, and other factors outside Eternal Trading's control.

We do not guarantee uninterrupted access, instantaneous delivery, or receipt of every alert. Your brokerage platform should be used to confirm current market prices, order status, fills, and executable prices.

Past performance is not indicative of future results. Performance shown by Eternal Trading is historical and does not guarantee future profitability, similar returns, or any particular trading outcome.

Some trade-history records may be designated as historical and may have been added to the platform after the original trade date. Historical records are not representations that an alert was delivered contemporaneously through the Eternal Trading notification system at the original trade time.

Unless expressly stated otherwise, displayed realized profit and loss may not reflect all brokerage commissions, exchange or regulatory fees, taxes, bid-ask spreads, slippage, differences in execution, or other costs that may affect your actual result.

The Service may display information or functionality supplied by third parties, including market-data widgets, authentication services, infrastructure providers, payment processors, and email providers. Third-party services may be delayed, unavailable, inaccurate, or subject to their own terms and privacy practices.

Any market-price reference labeled delayed or informational is not intended to represent an executable quote. Use your broker or trading platform as the source of truth for live or executable market information.

You agree not to:

• use the Service for unlawful, fraudulent, abusive, or deceptive activity;
• attempt to bypass subscription, authentication, authorization, or security controls;
• scrape, copy, redistribute, resell, republish, or commercially exploit subscriber-only alerts, data, or content without written permission;
• interfere with the operation or security of the Service;
• introduce malicious code or attempt unauthorized access to systems or accounts; or
• impersonate Eternal Trading or another person or entity.

The Eternal Trading name, branding, website, interface, alert presentation, original text, graphics, software, research presentation, and other proprietary content are owned by or licensed to Eternal Trading LLC and are protected by applicable intellectual-property laws.

Your subscription provides a limited, personal, non-exclusive, non-transferable right to access the Service for your own lawful use. It does not transfer ownership of Eternal Trading content or technology to you.

Our collection and use of personal information are described in the Privacy Policy, which is incorporated into these Terms by reference.

We may suspend or restrict access when reasonably necessary to address nonpayment, suspected fraud, security issues, misuse, violations of these Terms, legal requirements, or threats to the Service or other users. Where appropriate, we may terminate an account for material or repeated violations.

Suspension or termination does not eliminate obligations that accrued before the effective date of suspension or termination.

To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis. Eternal Trading disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, and results to the extent those warranties may lawfully be disclaimed.

Nothing in these Terms limits any warranty, consumer protection, or other right that cannot lawfully be excluded or waived.

To the fullest extent permitted by law, Eternal Trading LLC and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Service, including trading losses, lost profits, lost opportunities, lost data, service interruptions, or missed or delayed alerts.

To the fullest extent permitted by law, Eternal Trading LLC's aggregate liability arising from the Service will not exceed the subscription fees you paid to Eternal Trading during the six months immediately preceding the event giving rise to the claim. This limitation does not apply where applicable law prohibits it.

We may update these Terms from time to time. Material changes will be communicated through the Service, by email, by an updated notice on the website, or by another reasonable method. The revised Terms will identify their effective date.

Where applicable law requires additional consent to a material change, we will obtain that consent before applying the change as required.

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles, except to the extent another law must apply and cannot be waived by agreement.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
